General Terms & Conditions of Sale (CGV)

These General Terms & Conditions of Sale (“T&C”) govern all distance sales concluded via the website www.jonny-seeds.com (the “Website”) between:

and any natural person acting for purposes which are outside their trade, business, craft or profession (the “Customer”).

1. Scope & Application

1.1 These T&C apply to all orders of products placed by Customers via the Website and to any associated services (including newsletter subscriptions where relevant).

1.2 By placing an order or subscribing to the newsletter, the Customer acknowledges that they have read, understood and accepted these T&C in full.

1.3 Jonny Seeds’ may amend these T&C from time to time. The version in force at the time the Customer places an order applies to that order. The current version is always available on the Website.

1.4 These T&C are provided in English. Where translations are provided, the English version will prevail in case of discrepancy, without prejudice to mandatory consumer protection rules.

3. Products, Orders & Fulfillment

3.1 Jonny Seeds’ offers, in particular:

  • cannabis seeds sold as adult collectibles and for genetic preservation;
  • branded merchandise (apparel, accessories and similar products);
  • grow equipment and related items.

Certain items (for example, apparel) may be produced and shipped directly by carefully selected third-party fulfilment partners acting on behalf of Jonny Seeds’.

3.2 Product descriptions, characteristics and images on the Website are provided for information purposes. While Jonny Seeds’ takes reasonable care to ensure accuracy, images are illustrative and non-binding. The Customer is invited to read the full product description before ordering.

3.3 All offers are subject to availability. Jonny Seeds’ reserves the right to refuse or cancel an order, for example in case of obvious error, suspected fraud, supply issues or legal restrictions related to the destination country. In such cases, any amounts already paid will be refunded.

3.4 Age restriction (seeds): Orders for cannabis seeds may only be placed by Customers who are at least 18 years old or have reached the age of majority in their country of residence. Jonny Seeds’ reserves the right to request proof of age and to cancel orders where age cannot be verified.

3.5 Where products are fulfilled by third-party partners, the Customer remains contractually linked to Jonny Seeds’. Any applicable additional conditions of such partners (e.g. specific packaging or return addresses) apply in addition to these T&C, without prejudice to the Customer’s mandatory statutory rights.

4. Prices & Payment

4.1 All prices are shown in euro (EUR) and include Luxembourg VAT where applicable. Any applicable shipping costs, customs duties or import taxes (for deliveries outside Luxembourg) are indicated separately before final confirmation of the order.

4.2 The final total price, including all taxes and shipping costs, is shown at checkout before the Customer confirms the order.

4.3 Accepted payment methods are indicated on the Website and at the beginning of the order process. These may include, for example:

  • credit/debit card (e.g. Visa, Mastercard); (INSERT WEBSITE LINK to T&C)
  • online payment services (e.g. PayPal, Stripe or equivalent); (INSERT WEBSITE LINK to T&C)
  • payment via third-party cryptocurrency payment processor; INSERT WEBSITE LINK to T&C)
  • direct bank transfer to the bank account of C.C.C. AgriSol vGmbH

The payment methods offered may vary depending on the Customer’s country and order amount.

4.4 Payments made by card, online payment service or cryptocurrency are processed by independent payment service providers. By selecting one of these methods, the Customer enters into a separate contractual relationship with the relevant provider and accepts its terms of use and privacy policy. Jonny Seeds’ does not have access to, nor does it store, the Customer’s full payment card details. The identity of the payment service providers used for a given transaction is displayed at the latest at the payment step during checkout.

4.5 The price is due and payable in full upon order confirmation. The order is only considered accepted once payment has been successfully authorised.

4.6 Where the Customer chooses direct bank transfer, the order will be processed after receipt of the full amount in the bank account indicated by Jonny Seeds’. The Customer is responsible for any transfer fees charged by their bank and for correctly indicating the order reference provided. If payment is not received within 15 days, Jonny Seeds’ reserves the right to cancel the order.

4.7. Cryptocurrency payments

(a) Where available, the Customer may pay via a supported cryptocurrency through a third-party crypto payment processor. Prices on the Website are always displayed in euro (EUR). The crypto amount to be paid is calculated by the payment processor at the time of payment based on the applicable exchange rate and any network fees.

(b) Due to the nature of cryptocurrency transactions, payments are generally irreversible. The Customer is responsible for using the correct wallet address and network as indicated by the payment processor.

(c) In case of a refund for an order paid in cryptocurrency, Jonny Seeds’ will, unless otherwise agreed, refund the corresponding amount in euro to a bank account or other payment method designated by the Customer. Jonny Seeds’ is not responsible for exchange rate fluctuations between the time of the original payment and the refund.

5. Shipping & Delivery

5.1 Jonny Seeds’ currently delivers to Luxembourg and selected EU countries. Delivery restrictions and any destinations excluded (for example due to local legal rules regarding cannabis seeds) are indicated on the Website at the latest at the beginning of the order process.

5.2 Orders containing different product types (e.g. seeds and apparel, or seeds and equipment) may be shipped in separate parcels from different locations or fulfilment partners.

5.3 Estimated delivery times are indicated during checkout and in the order confirmation. These are indicative only and not guaranteed. In all cases, delivery will take place within 30 days of order confirmation, unless the parties agree otherwise.

5.4 The Customer is responsible for providing complete and accurate delivery information. Jonny Seeds’ is not liable for delays or non-delivery caused by incorrect or incomplete address details provided by the Customer.

5.5 Passing of risk:

  • For consumer Customers, the risk of loss or damage to the goods passes when the Customer (or a third party designated by the Customer, other than the carrier) physically takes possession of the goods.
  • If the Customer expressly chooses their own carrier, not offered by Jonny Seeds’, risk passes to the Customer upon handover of the goods to that carrier.

5.6 Further details are set out in the Shipping Information section of the Website, which forms part of these T&C. 

6. Right of Withdrawal (Consumer Purchases)

6.1 In accordance with Luxembourg and EU consumer law, Customers who purchase as consumers at a distance have a legal right to withdraw from the contract without giving any reason within 14 calendar days.

6.2 The withdrawal period starts on the day after the Customer, or a third party designated by them (other than the carrier), physically receives the goods of the relevant order.

6.3 To exercise the right of withdrawal, the Customer must notify Jonny Seeds’ of their decision within the 14-day period, for example by email to js@jonny-seeds.com. The Customer should indicate:

  • order number;
  • products they wish to return;
  • name and address.

The Customer may, but is not obliged to, use a standard withdrawal form.

6.4 The Customer must return the goods to the return address communicated by Jonny Seeds’ without undue delay and no later than 14 days after notifying withdrawal. The deadline is met if the Customer sends the goods before the 14-day period expires.

6.5 Unless otherwise specified in these T&C or agreed individually, the direct cost of returning the goods is borne by the Customer. The Customer is responsible for adequately packaging the products and for any risk during return shipment.

6.6 Jonny Seeds’ will refund all payments received for the returned products, including the standard delivery costs (if applicable), without undue delay and at the latest 14 days after being informed of the Customer’s decision to withdraw. Jonny Seeds’ may withhold the refund until the goods are received back or until the Customer has provided proof of dispatch, whichever is earlier.

6.7 Refunds are made using the same payment method as for the original transaction, unless expressly agreed otherwise.

6.8 The Customer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (similar to what would be allowed in a physical shop). For cannabis seeds, this means that the Customer may inspect the external packaging and read all information on the label, but must not open or tamper with the sealed original breeder packs or protective inner packaging. Once these seals are broken, Jonny Seeds’ can no longer verify the authenticity and integrity of the contents or resell the pack as “unopened”. Where goods have been handled beyond what is necessary for inspection, Jonny Seeds’ may deduct the diminished value from the refund due under the right of withdrawal, which for opened cannabis seed packs may be up to 100% of the price of the affected product.

7. Exclusions from Withdrawal – All Product Types

The legal right of withdrawal does not apply, in particular, to contracts concerning:

  • goods made to the Customer’s specifications or clearly personalised (e.g. custom-printed merchandise);
  • goods which are liable to deteriorate or expire rapidly;
  • sealed goods which are not suitable for return for reasons of health protection or hygiene and which were unsealed after delivery;
  • digital content not supplied on a tangible medium, once performance has begun with the Customer’s prior express consent and acknowledgement of loss of the withdrawal right.

For cannabis seeds and most merchandise/grow equipment, the standard 14-day withdrawal right applies, subject to the conditions in Section 6.

In particular, seeds must not have been germinated or otherwise used, and the original sealed breeder packs must remain unopened and untampered. If the sealed breeder pack has been opened or damaged in a way that goes beyond what is necessary to inspect the product (e.g. to read the label), Jonny Seeds’ may consider that the pack has no remaining resale value and may deduct up to 100% of its price from the refund.

8. Product-Specific Terms

8.1 Cannabis Seeds

  • To be eligible for a refund under the right of withdrawal, cannabis seeds must be returned in their original, unopened and untampered sealed breeder packaging, with all labels and batch information intact.
  • If the original breeder packaging or inner protective seal has been opened, altered or damaged, Jonny Seeds’ can no longer verify the origin, integrity or authenticity of the seeds. In such cases, the seeds are treated as having no resale value, and Jonny Seeds’ may deduct up to 100% of the price of the affected product from any refund due.
  • Due to the biological nature of seeds, germination and growth results depend on factors outside Jonny Seeds’ control (storage, environment, cultivation methods). Jonny Seeds’ therefore does not guarantee specific germination rates or yields, without prejudice to the Customer’s statutory rights regarding conformity of the goods as delivered (correct variety, quantity, freedom from visible defects on delivery).

8.2 Merchandise (Apparel, Accessories & Similar Products)

  • Some merchandise may be produced and shipped by external fulfilment partners on behalf of Jonny Seeds’. Jonny Seeds’ remains the Customer’s contractual contact point.
  • To be eligible for return under the right of withdrawal, merchandise must generally be unworn, unwashed and in saleable condition, with all original tags and packaging. Normal trying-on is permitted, but visible usage or damage may lead to a deduction for diminished value.
  • Customised or print-on-demand merchandise (e.g. limited special designs with personalised elements) may be excluded from withdrawal if they qualify as “goods made to the Customer’s specifications or clearly personalised” (see Section 7).

8.3 Grow Equipment

  • Grow equipment must be complete (all accessories, manuals, cables, etc.) and returned in proper packaging to avoid damage.
  • Equipment that has been used more than necessary to test basic functioning (for example, worn or used grow lights or broken seals on nutrient bottles) may be subject to a deduction for diminished value, or may fall under hygiene/safety exclusions where applicable.
  • If equipment is faulty on arrival or develops a defect within the legal guarantee period, Jonny Seeds’ will assist the Customer with repair or replacement in accordance with the legal guarantee rules (see Section 9).
  • When Grow equipment is fulfilled directly by third-party suppliers. Jonny Seeds’ coordinates returns, but the supplier’s return terms apply if stricter.

9. Defective, Damaged or Incorrect Products – All Product Types

9.1 If a product is delivered visibly damaged, defective, or does not correspond to the order (e.g. wrong variety or size), the Customer should contact Jonny Seeds’ as soon as reasonably possible at js@jonny-seeds.com , providing:

  • order number;
  • description of the issue;
  • clear photos of the product and packaging if relevant.

9.2 This initial contact should ideally be made within a short time after discovery of the issue, but in any event without prejudice to the Customer’s statutory rights, including the 2-year legal guarantee of conformity for consumer goods under Luxembourg law.

9.3 For seeds, this section covers issues such as:

  • damaged or opened packaging on delivery;
  • incorrect variety or quantity supplied.
  • Germination or cultivation outcomes, which depend on external growing conditions, are assessed case by case and are not guaranteed.

9.4 Where a lack of conformity is established within the legal guarantee period, the Customer is entitled, in accordance with applicable law, to have the goods brought into conformity free of charge (repair or replacement), or to a price reduction or termination of the contract in the cases provided by law.

9.5 Where a product has been produced or shipped by a third-party fulfilment partner, Jonny Seeds’ will handle communication with that partner. This does not affect the Customer’s rights against Jonny Seeds’ as seller.

10. Refund Processing

10.1 Approved refunds (for withdrawals, non-conformity or other agreed reasons) will be made within the time limits and conditions described in Sections 6 and 9.

10.2 Refunds are made using the same means of payment as used for the initial transaction, unless the parties expressly agree otherwise and provided that the Customer does not incur any fees as a result.

Important Note on Split Shipments: For orders containing seeds and merchandise and/or grow equipment, products may arrive in separate shipments from different locations, each with its own delivery timeframe and return address. Returns must be handled separately for each product type, and Jonny Seeds’ will provide clear instructions for each case if a return is requested.

11. Liability

11.1 Jonny Seeds’ is liable for damages suffered by the Customer only to the extent provided by applicable law and these T&C. Indirect or consequential damages (such as loss of profit, loss of data, or loss of opportunity) are excluded to the fullest extent permitted by law.

11.2 Nothing in these T&C excludes or limits Jonny Seeds’ liability for:

  • death or personal injury caused by its negligence;
  • fraud or fraudulent misrepresentation;
  • gross negligence;
  • any other liability that cannot legally be excluded or limited (including the mandatory legal guarantee of conformity).

11.3 Where products are produced or shipped by third-party fulfilment partners, Jonny Seeds’ remains responsible towards the Customer for proper performance of the contract, without prejudice to any rights Jonny Seeds’ may have against such partners.

12. Legal Compliance

12.1 The Customer is responsible for ensuring that purchasing, possessing and, where relevant, importing the ordered products (particularly cannabis seeds and grow equipment) is lawful in their country or region. Jonny Seeds’ does not provide legal advice on foreign laws.

12.2 Orders shipped outside Luxembourg may be subject to customs duties, taxes and import formalities in the destination country. These costs and formalities are the sole responsibility of the Customer.

12.3 Parcels may be inspected, delayed, or seized by customs or other authorities in the destination country.

  • Where a parcel is returned to Jonny Seeds’ due to customs reasons unconnected with an outright prohibition of the products (for example, incomplete documentation that can be corrected), Jonny Seeds’ will, where feasible, propose re-shipment (with any additional shipping costs borne by the Customer) or a refund of the product price minus original shipping costs.
  • Where a parcel is confiscated or destroyed by customs or authorities because the products are prohibited under the destination country’s law, Jonny Seeds’ will not be obliged to refund or reship, except where the issue results solely from an error on its part (for example, manifestly incorrect customs declarations).

12.4 Nothing in this section limits the Customer’s non-waivable rights under applicable consumer protection law. Clauses that would be considered unfair under the Luxembourg Consumer Code do not apply.

13. Data Protection & Newsletter Subscription

13.1 Personal data provided by the Customer when using the Website, placing orders or subscribing to the newsletter is processed in accordance with the Jonny Seeds’ Privacy & Cookie Policy, available on the Website, and with Regulation (EU) 2016/679 (GDPR) and applicable Luxembourg data protection law.

13.2 Newsletter subscriptions are based on the Customer’s consent, which can be withdrawn at any time via the unsubscribe link in each email or by contacting js@jonny-seeds.com. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

14. Applicable Law & Dispute Resolution

14.1 These T&C and any contracts concluded via the Website are governed by Luxembourg law, without prejudice to the mandatory consumer protection rules that may apply in the Customer’s country of residence.
14.2 In the event of a dispute, the Customer is invited to first contact Jonny Seeds’ at js@jonny-seeds.com to seek an amicable solution.
14.3 If no amicable solution can be reached, the courts of the Grand Duchy of Luxembourg will have jurisdiction, without prejudice to any jurisdiction rules that grant the Customer the right to bring proceedings before the courts of their place of residence.
